Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the Pole Apex website, league pages, and owner dashboard (together, the “Service”). The Service is operated by Pole Apex from Shkolla e Baletit, Rruga Petronin Luarasi, Tirana, Albania(“we”, “us”, or “our”).

By creating an account, starting a trial, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What Pole Apex provides

Pole Apex is a platform for F1 sim racing leagues. League owners use the dashboard to manage grids, results, rules, and calendars. Drivers and the public can view league pages, standings, and schedules without an owner account.

We may update, improve, or discontinue features over time. We will try to give reasonable notice when a change materially affects how you use a paid plan.

3. Accounts and eligibility

You must be at least 16 years old to register as a league owner. You are responsible for keeping your login details secure and for all activity under your account.

Information you provide during sign-up must be accurate. You may not impersonate another person, use a misleading league name, or create accounts to abuse trials or circumvent plan limits.

4. Subscriptions, billing, and trials

All plans (Soft, Medium, and Hard) are billed monthly in EUR unless we state otherwise. Prices shown on our pricing page include the details that apply at checkout. A 5-day trial may be offered on all plans; when the trial ends, your chosen plan continues unless you cancel before billing starts.

Subscription fees are generally non-refundable. Our Refund Policy explains this in full. Cancelling stops future charges; it does not automatically refund amounts already paid.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

When you subscribe, your payment is processed by Paddle. Paddle appears on your card or bank statement for subscription charges. For payment-related questions, refunds, or order disputes, contact Paddle support or us at support@poleapex.com — we will help you reach the right team.

5. Acceptable use

You agree not to:

• Use the Service for anything unlawful, harmful, or that infringes someone else's rights.
• Upload malware, scrape the Service without permission, or attempt to bypass security or rate limits.
• Harass stewards, drivers, or our team through league pages or support channels.
• Resell or white-label access in a way that violates your plan, unless your plan explicitly allows it.

We may suspend or terminate accounts that break these rules, with or without notice depending on severity.

6. Your content and league data

You keep ownership of the content you upload (league names, logos, rules, results, and similar material). You grant us a limited licence to host, display, and process that content solely to run the Service — for example, to show your public league page or calculate standings.

You are responsible for having the right to use any branding or media you upload, and for the accuracy of results and standings you publish.

7. Intellectual property

Pole Apex, our logo, site design, and software are our property or our licensors'. These Terms do not give you any right to our trademarks or code except as needed to use the Service as intended.

8. Disclaimers

The Service is provided “as is” and “as available”. Sim racing platforms, game updates, and network conditions are outside our control. We do not guarantee uninterrupted access, error-free standings, or that the Service will meet every league's specific sporting rules.

Nothing in these Terms limits rights you may have under mandatory consumer protection law in Albania where those rights cannot be waived by contract.

9. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages — including lost profits, lost data, or reputational harm — arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the fees you paid us in the twelve months before the event giving rise to the claim, or €100 if you paid no subscription fees in the preceding twelve months.

10. Termination

You may close your account at any time through the dashboard or by contacting support@poleapex.com. We may terminate or suspend access if you breach these Terms or if we stop offering the Service.

After termination, we may retain certain data as described in our Privacy Policy, for example where the law requires it or to resolve disputes.

11. Complaints

We aim to resolve issues fairly and promptly. If something has gone wrong with the Service, contact us before escalating.

How to complain — email support@poleapex.com, call +355 68 451 6860, or use our contact page. Include your account email, league name, and a clear description of the issue.

Billing and subscriptions — payment, refund, and cancellation disputes for orders placed through Paddle should be directed to Paddle support in the first instance, as Paddle is the Merchant of Record. We will still help you find the right channel if you contact us.

Our response times — we acknowledge complaints within 5 business days and aim to provide a substantive response or resolution within 15 business days. Complex cases may take longer; we will keep you updated.

If you are still not satisfied — for data-protection matters you may contact the Commissioner for Right to Information and Personal Data Protection (KDIIP). For other unresolved disputes, you may pursue remedies under applicable law before the competent courts in Tirana, Albania, or as required by mandatory consumer protection rules in your country of residence.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Albania. Any dispute that cannot be resolved informally should be brought before the competent courts in Tirana, Albania, unless mandatory consumer rules in your country of residence require otherwise.
